Terms of service

In short: The seller is Smart Trade Praveer Lakhani (PRINTEX), based in Poland. We print fabric to order. Consumers in the EU/EEA have 14 days to withdraw from the contract from receipt of goods — except for custom-printed items (made to your specification), where this right does not apply (art. 16(c) of EU Directive 2011/83 / art. 38 § 3 of the Polish Consumer Rights Act). Complaints are resolved within 14 days of submission.

§ 1. Definitions

  1. Seller / Service Provider / PRINTEX – Praveer Lakhani conducting business under the name "Smart Trade Praveer Lakhani", al. Krakowska 27, 05-090 Sękocin Nowy, Poland, VAT no. PL7010945438, REGON 384383242.
  2. Store / Service – the websites at druktkaniny.pl and printextiles.com operated by the Seller.
  3. Customer – a natural person with full legal capacity, a legal entity, or an organisational unit placing an order.
  4. Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.
  5. Sole proprietor with consumer rights – a natural person concluding a contract directly related to their business activity, where the contract is not of a professional character for them. (Polish law category equivalent to a B2C consumer for protection purposes — see art. 7aa of the Polish Consumer Rights Act.)
  6. Goods – fabrics, swatches, finished prints, and other products offered by the Seller.
  7. Printing Service – the service of digitally printing artwork provided by the Customer onto the chosen fabric.
  8. Order – a Customer's declaration of intent aimed at concluding a Sales Contract for Goods or a Service Contract for the Printing Service.
  9. B2B account – a wholesale customer account with individual pricing and payment terms, activated after verification by the Seller.
  10. B2C account – a retail customer account using the public Service prices.
  11. Terms – these terms of service.

§ 2. General provisions

  1. These Terms set out the rules of using the Store, placing Orders, delivery, payment, complaints, and the right of withdrawal.
  2. The Seller sells through the Store to Consumers, sole proprietors with consumer rights, and other Entrepreneurs.
  3. Using the Store requires: a device with Internet access, a current web browser supporting JavaScript and cookies, and — for placing Orders — an active email address.
  4. The Customer undertakes not to supply unlawful content and to use the Store in a way that is compliant with the law and good practice.

§ 3. Customer accounts

  1. Creating an account in the Store is voluntary and free. Placing an Order does not require an account.
  2. B2C accounts are activated automatically upon registration. B2B accounts require Seller verification — until approved, Customers see prices as "request a quote".
  3. The Customer must provide truthful data and keep it up to date. The Customer is responsible for protecting their password.
  4. The Customer may delete the account at any time by contacting the Seller or using the function in the account panel. Account deletion does not affect the obligation to retain accounting documents under applicable law.

§ 4. Placing Orders

  1. Placing an Order consists of: choosing the fabric and parameters, uploading artwork or specification, providing delivery and invoice details, accepting these Terms, and submitting the form.
  2. Upon receipt, the Seller sends the Customer an email confirming receipt of the enquiry. This is not yet acceptance of the offer.
  3. Within 24 hours on business days, the Seller verifies the artwork and fabric availability and sends the Customer a confirmation with quote and lead time. The contract is concluded when the Customer accepts the confirmation.
  4. The Seller reserves the right to refuse an Order if the artwork infringes third-party rights (in particular copyright or trade marks), contains unlawful content, or is technically impossible to execute to the requested quality.
  5. The Customer warrants that they hold all necessary rights to the artwork submitted for printing and that printing it will not infringe third-party rights. The Customer indemnifies the Seller against third-party claims arising from infringement of rights to the artwork.

§ 5. Prices and payment

  1. Prices in the Store are quoted in PLN (or EUR / GBP / USD where indicated) and include VAT (gross price) unless explicitly stated otherwise. Prices do not include delivery costs, which are charged separately.
  2. B2B accounts may see net prices and individual rates pursuant to an accepted commercial offer.
  3. Payment methods:
    • Bank transfer – available to all Customers; processing starts upon receipt of funds.
    • Online payment (card, BLIK, instant transfers) – handled by the payment operator (e.g. Viva Wallet) — available to B2C Customers.
    • Deferred payment – available exclusively to approved B2B Customers under individual commercial terms.
  4. A VAT invoice is issued and sent electronically to the Customer's email, upon dispatch of the Goods or — for prepayment — upon receipt of funds.

§ 6. Order fulfilment and delivery

  1. Lead time is stated in the Order confirmation and counted from: receipt of prepayment (B2C) or Order confirmation (B2B with deferred payment).
  2. Standard print time is 5–10 business days, depending on metreage, fabric, and production queue.
  3. Delivery is by courier. Delivery time within Poland: 1–2 business days; rest of Europe: 2–5 business days.
  4. Delivery cost is given in the Order confirmation, before the contract is concluded. Accepting the confirmation includes accepting the delivery cost.
  5. When the Goods are handed over to the courier, responsibility for their condition passes to the courier. For Consumers, responsibility passes to the Consumer upon physical delivery by the courier.

§ 7. Right of withdrawal (Consumer and sole proprietor with consumer rights)

  1. A Consumer or sole proprietor with consumer rights has the right to withdraw from a distance contract within 14 days of receiving the Goods, without giving any reason and without bearing costs other than those listed below.
  2. To exercise this right, inform the Seller of the decision by an unambiguous statement — e.g. by email to shop@printextiles.com. You may use the model withdrawal form attached as Annex 1, but you are not required to.
  3. If you withdraw, the Seller refunds all payments received, including standard delivery costs (excluding extra costs of a delivery option other than the cheapest standard one), promptly and no later than 14 days from receiving the withdrawal notice.
  4. Refunds use the same payment method you used, unless you expressly agree otherwise.
  5. The Seller may withhold the refund until receiving the Goods back or proof of return, whichever is earlier.
  6. Direct return shipping costs are borne by the Consumer.
  7. Exception — custom-printed goods

  8. Under art. 16(c) of EU Directive 2011/83/EU and art. 38 § 3 of the Polish Consumer Rights Act of 30 May 2014, the right of withdrawal does not apply to contracts for the supply of goods made to the Consumer's specifications or clearly personalised.
  9. This means that for the Printing Service — where the fabric is printed with artwork supplied by the Customer — the right of withdrawal does not apply. The Customer is informed of this in the Order confirmation before acceptance.
  10. The right of withdrawal does apply to purchases of unprinted (stock) fabrics and swatch samples.

§ 8. Complaints (statutory warranty)

  1. The Seller is liable for the conformity of the Goods with the contract under the Polish Civil Code and — for Consumers and sole proprietors with consumer rights — under the Polish Consumer Rights Act of 30 May 2014.
  2. Complaints may be submitted:
  3. A complaint should include: the Customer's details, the Order number, a description of the non-conformity (preferably with photos), and the desired remedy (repair, replacement, price reduction, withdrawal).
  4. The Seller examines the complaint within 14 days of receipt. Failure to reply within this period means the complaint is upheld — for Consumers and sole proprietors with consumer rights.
  5. If the complaint is upheld, the Seller covers return shipping costs.
  6. Colour complaints: due to differences in monitor calibration and print processes, minor colour deviations (ΔE up to 5) do not constitute a defect. We recommend ordering a swatch before mass production.

§ 9. Liability

  1. Towards Consumers and sole proprietors with consumer rights, the Seller is liable under generally applicable law.
  2. Towards other Customers, the Seller's liability for non-performance or improper performance of the contract is limited to the value of the Order to which the claim relates. The Seller is not liable for lost profits.
  3. The Seller is not liable for delays caused by circumstances beyond its control (force majeure, courier actions, power-grid failures, natural disasters, administrative restrictions).

§ 10. Personal data and cookies

§ 11. Out-of-court dispute resolution

  1. EU-based Consumers may use the ODR platform: ec.europa.eu/consumers/odr.
  2. In Poland, Consumers may also approach a permanent consumer arbitration court, the regional inspector of Trade Inspection (WIIH), or the consumer ombudsman at the county/municipal level for free assistance.

§ 12. Changes to these Terms

  1. The Seller reserves the right to amend these Terms. Customers with accounts will be notified by email at least 14 days before changes take effect.
  2. Orders placed before the change are governed by the Terms in force at the time of placement.

§ 13. Final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Polish Civil Code, the Consumer Rights Act, the Electronic Services Act, and GDPR.
  2. Disputes with Consumers are heard by the courts having jurisdiction under the Polish Code of Civil Procedure. Disputes with other Customers are heard by the court having jurisdiction over the Seller's registered office.
  3. These Terms enter into force on 12 May 2026.
